    Introduction

    DeptOfVibe, LLC ("DeptOfVibe," "Company," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Dept of Vibe website and film simulation service (the "Service").

    By accessing or using the Service, you consent to the practices described in this Privacy Policy. If you do not agree with our practices, please do not use the Service.

    Information We Collect

    Account Information: When you create an account, we collect your email address, name if provided, profile information from authentication providers such as Google or Apple, and account preferences.

    User Content: We temporarily process the images you upload to provide the Service. This includes original uploaded images, image metadata, processing parameters, and selected film stocks.

    Usage Data: We automatically collect information about your interaction with the Service, including features accessed, simulations performed, credit usage, subscription activity, device information, IP address, approximate location, access times, and referring URLs.

    Payment Information: When you make a purchase, payment information is collected and processed by Stripe. We receive only limited information such as the last four digits of your card, card type, and billing address for record keeping.

    How We Use Your Information

    Image Processing and Data Handling

    Processing Protocol: Your images are processed through our film simulation pipeline to generate styled outputs. Images are transmitted securely, processed in memory and temporary storage, and made available for download after processing.

    Identity Preservation: Our processing is designed to preserve the identity and geometry of subjects in your images. We do not alter facial features or body geometry beyond the film emulation effect.

    No Model Training: We do not use your personal images to train machine learning models. Your images are processed solely to deliver the requested simulation output.

    Output Retention: Processed outputs may be temporarily cached to enable download and are periodically purged from our systems. You may request immediate deletion of your outputs at any time.

    Data Sharing and Disclosure

    We do not sell your personal information. We may share your information with trusted service providers who perform services on our behalf, including Stripe, cloud infrastructure providers, email service providers, and analytics providers.

    These providers are contractually obligated to protect your information and may only use it to perform services for us. We may also disclose information if required by law, subpoena, or legal process, or if disclosure is necessary to protect our rights, your safety, or the safety of others.

    In the event of a merger, acquisition, or sale of assets, your information may be transferred to the acquiring entity.

    Data Security

    We implement industry standard security measures to protect your information, including encryption of data in transit and at rest, secure authentication protocols, regular security assessment, monitoring, access controls, and employee training.

    No method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security of your information.

    Data Retention

    • Account DataRetained while your account is active and for a reasonable period thereafter for legal and business purposes.
    • User ContentOriginal images are deleted after processing; outputs are retained temporarily for download.
    • Usage DataRetained in aggregated or anonymized form for analytics and service improvement.
    • Payment RecordsRetained as required by tax and financial regulations.

    Your Rights and Choices

    Depending on your location, you may have rights to access, correct, export, or delete personal information we hold about you. You may also opt out of marketing communications by clicking the unsubscribe link in our emails or updating your account preferences.

    California Privacy Rights

    If you are a California resident, you have additional rights under the California Consumer Privacy Act, including the right to know what personal information we collect, the right to request deletion, the right to opt out of the sale of personal information, and the right to non discrimination for exercising your privacy rights.

    We do not sell personal information. To submit a California privacy request, contact us at lab@deptofvibe.com with "CCPA Request" in the subject line.

    European Privacy Rights

    If you are located in the European Economic Area, you have rights under the General Data Protection Regulation, including access, rectification, erasure, restriction of processing, data portability, objection to processing, and withdrawal of consent.

    Our legal basis for processing your personal data includes performance of our contract with you, your consent, our legitimate business interests, and compliance with legal obligations. You may also lodge a complaint with your local data protection authority.

    Cookies and Tracking Technologies

    We use essential cookies to maintain your session, remember preferences, and enable core functionality. We may use analytics cookies to understand how visitors interact with the Service and improve user experience.

    You can control cookies through your browser settings. Disabling certain cookies may affect Service functionality.

    Children's Privacy

    The Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected information from a child, we will take steps to delete it promptly.
